Avast Scan Option In Recycle Bin

I am using Win 7 Home Premium.

I downloaded stock photos and renamed them. When I put one in the recycle bin and empty the recycle bin, there is an option for Avast to scan it for viruses but this option is not offered when the recycle bin is empty-Why would there be a scan option in the recycle bin folder and why is the file named after its stock name not my name for it?

I get this weird and unnecessary right-click option every time there is something in my Trash. And how could i select some items from the trash when i haven't even opened it yet?
Is there a way to get rid of it? On XP btw.
