I haven't made a system backup yet but would it be safe to install win 10?  I'm going to send this computer back to Dell and get a win 10 laptop.

Will set it back to factory settings before sending it back.

That depends on what you're allowed to do to the computer and still return it to them. You can just simply update this one and it would be the same as if
you bought a windows 10 computer.

Well, since this machine is the only one that has Windows 10 and, it doesn't have a Wi-Fi card, I think I'm safe. :-)

It just seems like a waist of time to send it back and wait for a new one when upgrading it is much faster and the process is fairly easy.

Well, setup seem not that much different from smartphones or tablets, they are always looking for wi-fi connections as you move about.  Some vendors have them set up to connect to any available wi-fi connection without notifying you and permanently remembering them.  Offhand, Microsoft's iteration seems similar. 

To know that would require further investigation.

[EDIT:]  Wi-fi Sense appears to be allowing others to use your wi-fi connection, correct?

Simple answer is yes. They need to be in range to do so. Where I live that limits it pretty much to those that visit my home. :)
You can also restrict what they can actually access by isolating yourself from what can be accessed.

The only tiny problem I have with the upgrade is that Ilost my access to my numeric pad. I just can't use it. I tried to uninstall it from the device manager but there is no way to change the driver to the old one. I'm looking over the internet for a solution. My mouse works rather fine now with the new driver I reinstalled (bad installation) but seemed to work better on win 8.1!

I've always had good luck in updating drivers by using Drive the Life. More information here:

Your web download was suspicious to K-9, probably a FP. Anyways I solved my problem by some head scratching since Google doesn't help. Go in Control Panel/Ergonomy settings/ Keyboard and untick use numeric pad as your mouse while activated (must be deactivated). I don't know why it's activated by default! :-X

That's exactly why I don't use any of that stuff.  No WOT, No K9, No WinPatrol, none of it.
