I certainly wouldn't consider it fair game, what they are doing is breaking the law in many countries and I expect they will get their fingers rapped.

When the whole idea of their actions was meant to detect 'secured wifi hot spots' they not only recorded all wifi connections secured or otherwise and by all accounts 'took' data, information.

I absolutely believe you should secure your wifi, but there are huge numbers that don't know this and are none the wiser. If you happen to leave your front door unlocked you don't expect people to enter and walk off with your property. In fact if you did that in the good old US of A your likely to get shot, not that I'm suggesting google gets shot ;D
