I honestly don't know if a driver update would make any difference if the graphics chip isn't Directx9 I don't see how a software update would change any hardware restriction.
Lets work this in an extreme way, Directx10 graphics cards are out there, but you couldn't simply run a driver update to make a directx9 graphics card/chip become directx10.
So you need to know what the graphics chip supports, but I would have thought for a reasonably new notebook it should have directx9 support.
