what version of avast free, pro / suite?

I recommend this case to make an uninstall tool
http://www.avast.com/pt-pt/uninstall-utility

https://support.avast.com/index.php?languageid=1&group=eng&_m=knowledgebase&_a=viewarticle&kbarticleid=1062

and left for a new installation

I agree with jefferson santiag, but you should try to uninstall the product with the uninstaller from programs and features first, then reboot to safe mode and use the uninstall tool. This is to avoid missing uninstalling any services or files that were not correctly installed. However if you can not use the uninstall feature built into avast because of an error then boot into safe mode before running the uninstaller tool.

New uninstaller tool  aswClear - http://files.avast.com/test5beta/aswclear.exe

Don't forget to reboot after either the repair or the re-install.

I have already tried the repair and a re install before posting.
Avast tells me it is up to date this morning however Windows 7 is still reporting that Avast is turned off.
Engine and definitions:  130216-0
program: 7.0.1474

any thoughts?  Is this a known issue?

Have you tried uninstalling from programs and features and then booting into safe mode and use the "awsclear.exe" removal tool provided by avast (Note: You must be in safe mode for this tool to do its job properly). The tool will remove any remnants of the previous version, you can get it here http://www.avast.com/uninstall-utility then reboot once more and reinstall.

If that does not solve your problem try and install the new beta of avast 8 it has many fixes on the previous version you can get it here www.avast.com/beta

1) uninstaller see reply no. 7
2) beta3 still has some bugs.  :)
