Much likely, no. The damaged parts would probably be copied and burned onto the next disc. If you want, you may try downloading ISO, CSO or IMG and run them in EPSXE instead, but as like any other say, its a form of piracy.
No offense but, I tried CD Rx Data Retriever about four years ago and it caused more screw ups on my damaged Breath of Fire IV CD.

Yeah, software most likely won't fix it.I've purchased CD repair tools in the past, and they have worked well.They actually sand the surface of the disc, to get down to where the scratches are and make them flat again.This is the one I used I think: http://www.amazon.com/Digital-Innovations-Skipdoctor-Repair-Kit/dp/B00005B9W6Once you have it repaired, make a copy (if it's not illegal to do so).
Try the toothpaste magic. It worked in mine.
